2. Purpose

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between the company Julie Mallet and any customer making a purchase on the website www.juliemallet.com (hereinafter referred to as "the site") or via any other sales channel, for products/services offered by the company Julie Mallet.

3. Acceptance of GTC

Any order placed on the site implies unreserved acceptance of these GTC. These may be subject to modification at any time, the version applicable to the order is that in force on the date of purchase.

4. Products and services

The products offered are described and presented with the greatest possible accuracy. However, the company Julie Mallet cannot be held responsible for any errors or omissions in this presentation. Product photos are non-contractual.

5. Price

Prices indicated on the site are expressed in euros, all taxes included (TTC), unless otherwise specified. Delivery costs and any other eventual costs are clearly mentioned before the customer validates the order.

The company Julie Mallet reserves the right to modify its prices at any time, but undertakes to apply the rates in force at the time of order validation.

6. Order

The customer can place an order via the site or any other channel designated by the company Julie Mallet. Any order is firm and definitive once confirmed by email.

The company Julie Mallet reserves the right to refuse any order in case of dispute with the customer, non-payment in full or in part of a previous order, or for any other legitimate reason.

7. Payment

Payment for orders is made via the methods offered on the site (credit card, PayPal, etc.). Payment must be made in full before delivery of the products. In case of default of payment, the order will be cancelled.

8. Delivery

Products are delivered to the address indicated by the customer when ordering. Delivery times are indicative and do not constitute an obligation of result for the company Julie Mallet. In case of delay, the customer will be informed as soon as possible.

Delivery costs are the responsibility of the customer, unless otherwise stated.

8. Legal Guarantees

Each object and luminaire is designed and manufactured with the utmost care, in a responsible approach.

In accordance with current legislation, the Seller is bound by the legal guarantees of conformity (articles L217-3 to L217-17 of the Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

The consumer has a period of two years from the delivery of the product to act under the legal guarantee of conformity. They can choose between repair or replacement of the product, subject to the cost conditions provided by law.
The legal guarantee of conformity applies independently of any commercial guarantee that may be offered.

The consumer can also invoke the guarantee against hidden defects if the product presents a hidden defect making it unfit for its intended use, or which diminishes its use to such an extent that they would not have acquired it, or would have paid a lesser price, had they known about it. In this case, they can choose between rescission of the sale or a reduction in price in accordance with article 1644 of the Civil Code.

Slight variations in appearance, shade or texture related to the manufacturing method of the pieces do not constitute defects in conformity and attest to the unique character of each creation.

10. Withdrawal and Returns

In accordance with article L221-18 of the Consumer Code, the customer has a right of withdrawal of 14 days from receipt of the order. To exercise this right, the customer must notify their intention in writing to the company Julie Mallet at hello@juliemallet.com.

Products must be returned in their original and complete condition (packaging, accessories, instructions). Return costs are the responsibility of the customer, except in case of product defect. Reimbursement will be made within 14 days of receipt of the return.

11. Liability

The company Julie Mallet cannot be held responsible for damages resulting from improper use of the products or non-compliance with the instructions provided, such as the use of a bulb other than LED in luminaires. 

Under no circumstances can the liability of the company Julie Mallet be engaged for any indirect damage, such as loss of turnover or damage to brand image.

12. Intellectual Property

All elements present on the site (texts, images, logos, brands, etc.) are protected by copyright and intellectual property rights. Any reproduction, total or partial, is strictly prohibited without prior written authorization.

13. Personal Data

Personal information collected during the order is necessary for order processing and commercial relationship management. In accordance with the Data Protection Act of January 6, 1978, as amended, the customer has a right to access, rectify and delete their personal data.

14. Dispute Resolution

These GTC are subject to French law. In case of dispute, the customer undertakes to first contact the company Julie Mallet to try to find an amicable solution. Failing agreement, the dispute will be submitted to the competent courts within the jurisdiction of the registered office of the company Julie Mallet.
