Julie Mallet Studio designs, manufactures, and sells objects and lighting, notably made using 3D printing from bio-based PLA and repurposed materials.

Hereinafter referred to as “the Seller”.

2. Purpose and Scope

These General Terms and Conditions of Sale (GTC) govern product sales made by the Seller to its customers via the www.juliemallet.com website or any other sales channel expressly referring to these GTC.

They specify, in particular, the conditions for ordering, payment, delivery, withdrawal, and the warranties applicable to the products sold.

3. Acceptance of GTC

Any order implies the unconditional acceptance of these GTC by the Customer.

The applicable GTC are those in force on the date of the order. The Seller reserves the right to modify them at any time, without such modifications affecting orders already concluded.

4. Products

The essential characteristics of the products are presented on the site with the greatest possible accuracy.

Photographs, renderings, colors, and depictions of the products are presented for illustrative purposes. Slight differences may result from screen display settings, the manufacturing process, or the materials used.

Due to the manufacturing process and the use of repurposed materials, slight variations in appearance, shade, or texture may occur from one piece to another. These variations inherent to the manufacturing process do not, by themselves, constitute a lack of conformity.

Some products are made to order. This information, as well as the estimated manufacturing time, is specified on the relevant product page.

5. Prices

Prices are indicated in euros, including all taxes (TTC), unless otherwise indicated.

Any delivery costs are indicated to the Customer before final confirmation of the order.

The Seller reserves the right to modify its prices at any time. The applicable price is the one displayed or agreed upon at the time of order confirmation.

For deliveries outside the European Union, customs duties, local taxes, or other fees may be required upon the arrival of the package. Unless otherwise indicated, these costs remain the responsibility of the Customer.

6. Ordering

The Customer may place an order via the website or, if applicable, directly with the Seller.

The order becomes final after validation of the order and confirmation of payment according to the procedures provided during purchase.

The Customer is responsible for the accuracy of the information provided during their order, in particular the delivery address.

The Seller reserves the right to refuse or cancel an order for any legitimate reason, particularly in the event of non-payment, a dispute relating to the payment of a previous order, exceptional product unavailability, or clearly erroneous information provided during the order.

7. Payment

Payment is made using the payment methods offered at the time of ordering.

Unless otherwise expressly agreed with the Customer, payment must be made in full before the product is shipped.

For certain orders subject to a quote or specific agreement, a deposit may be required. The applicable payment terms will then be specified on the quote or corresponding contractual document.

No shipment is made before payment of the amounts due.

8. Manufacturing and Delivery

Products are delivered to the address indicated by the Customer when ordering.

For products made to order, the manufacturing time is indicated on the product page or communicated to the Customer before order validation.

The applicable delivery time is indicated to the Customer before validation of their order and takes into account, if necessary, the time required to manufacture the product.

In the event of a delivery delay, the Customer is entitled to the rights provided by the applicable provisions of the Consumer Code.

Delivery costs are indicated before order validation and are payable by the Customer, unless otherwise stated.

Upon receipt of the package, the Customer is invited to check its condition and promptly report any damage observed to the Seller, accompanied if possible by photographs of the package and the product. This check does not deprive the Customer of the benefit of the applicable legal warranties.

9. Legal Warranties

The Seller is bound by the legal guarantee of conformity provided for by articles L.217-3 et seq. of the Consumer Code as well as the warranty regarding hidden defects provided for by articles 1641 et seq. of the Civil Code.

The consumer has a period of two years from the delivery of the product to obtain the implementation of the legal guarantee of conformity under the conditions provided by law.

When the legal conditions are met, the consumer may request the repair or replacement of the product. The terms of compliance are determined in accordance with the provisions of the Consumer Code.

The legal guarantee of conformity applies independently of any potential commercial warranty.

The consumer may also invoke the warranty against hidden defects when the product has a hidden defect rendering it unfit for the use for which it was intended, or which so diminishes this use that they would not have acquired it, or would have paid a lower price for it, had they known of it.

In this case, they may choose between rescission of the sale or a reduction of the price under the conditions provided by article 1644 of the Civil Code.

10. Right of Withdrawal and Returns

In accordance with article L.221-18 of the Consumer Code, the consumer has a period of fourteen days from receipt of the product to exercise their right of withdrawal, without having to justify their decision.

The Customer may exercise their right of withdrawal by sending the Seller an unambiguous statement expressing their desire to withdraw to hello@juliemallet.com, or by using the standard withdrawal form at the end of these GTC.

After notifying their decision, the Customer has fourteen days to return the product.

Products must be returned in a condition allowing them to be resold, accompanied by any accessories. The Customer may be held liable for any depreciation resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the product.

Direct return costs are borne by the Customer, except when the return is the result of non-conformity of the product.

In the event of a valid withdrawal, the Seller shall refund the amounts paid, including the initial delivery costs corresponding to the standard delivery method offered, under the conditions and within the time limits provided by law. The Seller may defer the refund until the product is recovered or until the Customer provides proof of shipment, whichever is earlier.

The right of withdrawal cannot, in particular, be exercised for products made to the Customer’s specifications or clearly personalized, in accordance with article L.221-28 of the Consumer Code.

The mere fact that a standard product is made to order does not, by itself, exclude the right of withdrawal.

11. Use of Products and Liability

The Customer agrees to use the products in accordance with their intended purpose and the instructions provided by the Seller.

Regarding lighting, the prescriptions indicated on the product page or the instruction manual must be respected. When a light fixture is specified for use with an LED bulb only, the use of any other type of bulb is prohibited.

The Seller cannot be held liable for damage resulting from abnormal, inappropriate use, or use contrary to the instructions provided, subject to applicable mandatory legal provisions.

These provisions shall not have the effect of excluding or limiting the rights and guarantees granted to the consumer under mandatory legal provisions.

12. Intellectual Property

The creations, texts, photographs, images, drawings, models, logos, and more generally the elements present on the site are protected by applicable intellectual property rights.

Any reproduction, representation, adaptation, or exploitation, in whole or in part, without the prior written authorization of the rights holder is prohibited, subject to exceptions provided by law.

The purchase of a product does not entail any transfer to the Customer of the intellectual property rights attached to its design.

13. Personal Data

Personal data collected in the context of orders and exchanges with the Customer are used in particular for order processing, delivery, invoicing, and customer relationship management.

The Customer benefits from the rights provided by the applicable regulations regarding personal data protection, in particular the rights of access, rectification, erasure, limitation, and, when the conditions are met, opposition and portability.

14. Applicable Law and Dispute Resolution

These GTC are subject to French law.

In the event of difficulty or dispute relating to an order, the Customer is invited to first contact the Seller at hello@juliemallet.com to seek an amicable solution.

Failing an amicable resolution, the dispute may be brought before the competent courts in accordance with the rules of common law.
